Why Does This Difference Matter?

Maybe first we’ll take a look at the two different species that exist in the neighborhood ecosystem.

“Stewards of Existing Conditions” are those currently living in their homes, and the “Sponsors of Proposed Projects” are those that are trying to live in their homes – or are those that are trying to make places for other people to live.  The Stewards tend to value “the way things were” and are much more powerful than the Sponsors.  This is because a.) they are living there now, or have been living there longer, and so they are a known entity to other residents and politicians, and b.) there are many more Stewards than Sponsors among the electorate. A Sponsor might not even live yet in the area, and therefore not be a relevant voice for the politician to care about because they can’t cast a vote.

Every municipality that has a Design Review process for proposed projects will have a list of codified “findings” that must be deemed “met” by those Commissioners tasked with its evaluation.  This process is also called “Discretionary Review” as the approval of the project is at the “Pleasure of the Planning Commission.”  Examples of Objective Criteria for a proposed project could include having at least a 12’ front yard setback, a maximum of .63 Floor-to-Area Ratio, and a maximum 47% Building Coverage Ratio. 

 If the criteria are clear and quantitative for the developer, then the predictability of timeline and budget estimates, and likelihood of a positive financial return, rise.  As contrast, examples of Subjective Criteria for a proposed project could include “must be consistent with neighborhood character”, “must not introduce too much bulk and mass,” and that there “must be enough light and air for adjacent properties.”

Those criteria are the trappings of the politicians and appointed officials – the right to the use subjective criteria being as coveted as access to oxygen.  Why?  Because it allows the official to gauge the sentiment of the Stewards/electorate, and if negative, pick a subjective finding or two that can’t be met.  Try arguing with a Planning Commissioner that your project does not occlude “light and air” from a neighboring structure.  Its impossible – there are no objective facts to work with.  It is totally subjective.

 These subjective criteria are of inestimable value to the official because they are directly related to the ability for these political operatives to be effective at securing votes from the Stewards.  And thus secure re-election, or re-appointment.

The Difference Between Subjective & Objective Design Criteria Municipalities Use For New Housing Developments

On October 2021, the San Francisco Board of Supervisors rejected a Planning Commission-approved project at 469 Stevenson Street.   The project would be built on what is currently a parking lot filled with a homeless encampment, in the middle of existing high-rises.  14% of those units would have been Affordable Housing (generally defined as units which have both maximum rents and tenant eligibility standards for a fixed period of time).  The Board’s reasons for the rejection included indeterminate reasons like “gentrification”, seismic concerns, and shadows.

This particular rejection relied on a Subjective Evaluation Orientation, because there was no Objective rationale whatsoever for denials of these project.  Both were rejected because of the vocal opposition of the local NIMBY constituents (the majority electorate in that district).  These two rejections of what were perfectly acceptable, and code compliant proposed projects, aroused the wrath of Sacramento, and in November of 2021 they gave San Francisco 30 days to provide “reasoning and evidence” for the decision.

The state is furious with these local municipalities because, in aggregate, they are contributing to homelessness, massive losses in tax dollars, and diminished national influence (for the first time in its history, California will lose a seat in the House in 2022).

A war has erupted between municipalities which are fighting for “local control” (lower left quadrant, the “status quo”) and the state – which is fighting to dismantle barriers to new development, and create more market rate and affordable housing in particular.

It is a war between the Collective Stewards of California and a super-power – with a GDP on par with Germany’s.  The state is furiously shining flashlights into the crevices of local municipal decision-making, trying to illuminate, isolate, and extinguish the emotional, political, and subjective vermin that are increasingly plaguing its host.  In essence trying to codify or otherwise impose an Objective Evaluation Orientation in order to re-calibrate the power dynamic.

And so the conflict continues.

  1. I like the objectivity of the story, and the two groups you define. I don’t think you needed the word “vermin” at the end, but I understand why you wrote it.

    This division into the two camps worries me. It seems difficult to get either side to understand each other. I’d like to hear more about why NIMBYs feel the way they do. In engineering, we have a similar phrase in a different subject area it’s called NIH which means not invented here. Engineers often feel that unless they create their circuit or device, nobody else could do it right. So it makes it hard for them to use other peoples contributions from outside their company. Even though they may be excellent.
